Damage Waiver
This Damage Waiver Agreement ("Agreement") is made between Hardy's BounceFest Limited t/a Hardy Soft Play Hire ("Provider") and the Hirer ("Hirer") who hires equipment from the Provider.
1. Damage Waiver Charge
1.1 A Damage Waiver charge amounting to 10% of the hire charge can be added to the hire contract at any point up to 24 hours before delivery,
2. Coverage under Damage Waiver
2.1 Under the Damage Waiver, the Provider will waive any further charges for rectifying accidentally damaged returned equipment. This will include damage such as, but not limed to:
a. Guests accidentally spilling food and drinks on the equipment, staining or damaging the surfaces.
b. Guests wearing stiletto heels to walk on soft play mats, causing punctures or tears in the material.
c. The family dog, left unsupervised, chews on a piece of equipment, causing tears or punctures in the material.
d. Despite instructions to remove shoes, a guest accidentally wears shoes on the equipment, leading to scuffs or scratches on the surface.
e. An unexpected electrical fault at the village hall causes a power surge that damages the electronic components of the equipment, necessitating repair or replacement.
f. Heavy decorations or centerpieces accidentally fall onto the equipment, causing dents or structural damage.
2.2 The Damage Waiver does not cover the following:
a. The first £20 or 10% (whichever is the greater amount) of any equipment damage claim.
b. Equipment loss or theft
c. Any claim for damage to the equipment if:
i. The equipment was left unattended overnight outside, unless the space is fully enclosed with a locked gate.
ii. The person responsible for supervising the equipment was under the influence of drugs and/or alcohol. This is the person who has signed the terms of hire, unless we are notified by email 24 hours before the event of the name of the person responsible for supervising the equipment during the event.
iii. The damage was intentional.
3. Hirer's Responsibilities
3.1 If the Hirer does not opt for the Damage Waiver, any damage to the equipment will be charged to the Hirer, with payment terms of 14 days.
3.2 Except where the Hirer opts for the Damage Waiver, the Hirer agrees to cover the cost of repairs up to and including a full replacement against the risks of loss, theft, and damage beyond economic repair.
4. Acceptance of Terms
4.1 The terms are conditions above of the Damage Waiver are accepted by either:
a. Ticking the box on the booking form when placing a booking through the website, or
b. Emailing info@hardysoftplayhire.co.uk after booking through the website, or after asking Hardy Soft Play Hire to manually place a booking, to request the addition of the Damage Waiver.
